Prime Minister’s Citizen Assistance and Relief in Emergency Situations Fund (PM CARES FUND): Whether it is Public Body or Politicians Private Trust?

Are we living in a healthy Democracy, whether citizens of this country does not have legitimate right to know how and what manner the Government Authorities are trying to look after their so called welfare of the people, who are in distress? The answer you will find is “No”, as you citizens, do not having any legal right to KNOW how the Government and most specifically the office of Prime Ministers Office under which the PM Cares Fund is set up for to look after the welfare of you to handle the emergency and other urgent issues concerning of you public.

In fact the very Prime Ministers National Relief Fund (PMNRF) which was established by the hands of then Prime Minister Jawaharlal Nehru by the demands of the then situations on 24.01.1948, at that time it was the need to handle issue of partition and with calamities and hence Government in order to make the said PMNRF fund into the format of “Trust”, therefore made an application before Income Tax Authority under section 12A of the Income Tax Act to make the said fund body as a Trust Body just for the purpose of allowing doners to avail Tax Exemption facility out of the donated amount from the Governments hand. And then since 18.9.1073 the said PMNRF got its own Pan Account Number and were operating its fund under the said trust claiming to spend for the welfare of people who are in distress?

When Modi Sarkar came in power and during the time of Covid, Prime Minister Office established another Prime Minister Cares fund as the said PM Cares fund was actually set up on 28.03.2020 to handle to the emergency situation like to face covid pandemic as the said fund was specifically set up before 4 days of closing of the financial year ending on 31st March 2020 and after setting up such Fund Body which their office is operated from the office of PMO office and still the PMO office is called the PM Cares fund called as a Private Body not considered it a Public Body. And under this PM Cares Fund within 4 days of its set up, the Corporate and other unknown doners made donations to this PM Cares Fund which was amounting to more than Rs. 3000 crores(Three Thousand Crores). Citizen imagine within 4 days of period such a huge amount was received to this PM Cares fund as this fund which was considered as a trust amount and our Prime Minister Shri Modi Jee is its Ex Officio Chairman and along with him there are 3 more prominent Central Cabinet Ministers who also are its trustees and all they are acting as its Ex Officio capacity to manage the fund of PM Cares account under the banner of Trust Amount.

It is shocking and surprised as when the said above PM Cares Fund was set up on 28.3.2020 and within 4 days Corporate bodies donated more than 3000 Crores of rupees and hence it seems the Ministry of Corporate Affairs it seems felt to make the said donation as legal and hence issued a Notification and amended the companies act by way of publishing its Notification dated 26.05.2020 and under the said notification the said Ministry very conveniently made it clear that the Corporate Bodies can now donate the funds under their Corporate Social Responsibility Funds (CSR) and said arrangement of CSR funds from Corporate Body is now legally can donate the funds to PM Cares fund account as the said notification is applicable with effect from the date of inception of PM Cares Fund that is 28.3.2020, imagine the Ministry of Corporate Affairs very well adjusted the activities of PM Cares fund from its very 1st day 28.3.2020 to make it to show that every thing is legal and adjustable at Centre, whereas the actual amendment carried over on 26.5.2020, and PM Cares Fund office started collecting donation prior to this amendment. We are surprised and shocked but judiciary is silent.

Citizen like you and me now can raise the issue that we must know who are those institutionalized body or corporate entities who are making such a huge donation which is in Crores And Crores to the PM Cares fund? and why these big Giants are paying such huge amount to PM Cares Fund? and how those said funds are really distributed? whether these donation amount really reach out to the welfare of the public or not ? and then really who is the actual beneficiary of this PM Cares Fund?. As when this info was sought to the PM Cares Fund Office as their office is located in the PMO office, but the Public Information Officer of PM Cares fund body had not given information to public stating their body is Private Body and not of Public Body, isn’t its a Joke of our Democracy. then citizen filed appeal before Central Information Commissioner who then directed the office of PM Cares fund to publish the names of institutionalized bodies corporate persons who have donated huge amount to the PM Cares fund, and when said PM Cares fund office decided not to give this info to Public their office conveniently filed Writ Petition before Delhi High Court against the said order, and then single judge of the Delhi High court Justice Rajiv Sahai rejected the petition of PM Cares Fund and then order of Central Information Commissioner was remained in operation to say to disclose the info of donors to PM Cares fund to the public and therefore as the PM CARES Fund managing team does not wish to provide the info funds to the public domain again challenged the said order and filed appeal before Division Bench of 2 Judges at Delhi High Court and then this bench of 2 judges took almost 8 months to decide the issue whether the PM Cares fund is a public body or private body and even their after surprisingly even after 8 months, could not clear the issue of PM Cares fund is public body or not. Hence public citizen of this state having grave concern and suspicious view whether the amount, donation which is collected by the office of PM Cares fund in the name of people welfare, and when these distress people asked the information of their welfare amount same is not disclosed by this PM Cares fund office, making unjust illegal claim that the said PM Cares Fund is not a Public Body but is a private entity, how member of public can digest this claim. In Marathi language there is saying like “KUMPANCH SHET KHATAYA.”

We the member of public feel grave concern for public interest to know when the corporate body under CSR fund made huge donation to the account of PM Cares Fund in the tune of Rupees 3000 crores that also within 4 days at the time of setting up its fund body, and now more than 4 years have lapsed how much money must have been collected under the said PM Cares Fund, it must be in billions, as per the sources disclosed the PM Cares fund distributed more than Rupees 23000 crores within earlier 2 years of its time, and people of this country not even known who is those beneficiary. Further even during covid period at Aurangabad Maha State, in the hospital some ventilators were given by the PM Cares fund and all those ventilators were carried a label of PM Cares fund, and the said ventilators came to be not operated well as were malfunctional and number of death had occurred due to said faulty ventilators and when the matter came up before the High Court the PM Cares fund which had given the said ventilators were denied to provide the documentary evidence claiming to be of private body and hence there was no transpiracy in the matter to run the said PM Cares fund.

Now people of this country having serious talk and debate and are now slowly making to understand the Rumors or factual things pertaining to destabilizing the Government of Maha State by the hands of ruling party of the Centre, it is said that Mighty Delhi Sarkar had paid 1 khoka i.e. 50 crores to each member of Eaknath Shende and there fore then Government of Maha State came down and then with the help of those Corrupt amount donated by Mighty Sarkar, the Eaknath Shende who could with the help of those KHOKA amount emerged as the Cheap Minister of the Maha State. People are well known the affairs of the Highly Placed Politicians in Delhi who in fact are having total control of PM Cares Fund which is shown to be set for public welfare, whether all those amount which is collected by these PM Cares fund is distributed to people who are in distress. In fact citizen are having confusion whether these funds are reaching out to the public or not or simply these Fund is distributed upon those rogues like of Maha State Traitor Legislatures who destabilized the then existing Government causing heavy burden on Tax Payer to face the upcoming Election. it is a matter of serious talk and now people feel at least this time Highest Judiciary must take the stand that the Right to Know of the people is to be protected only by way of directing the office of Prime Ministers Citizen Assistance and Relief in Emergency Situations Fund ( PM CARES FUND) to disclose the entire amount which are donated by the Corporate or other entities since 28.03.2020 to till date and also do inform and publish the names of beneficiaries who have received the funds from the said account of PM CARES Fund from since 28.3.2020 to till date. Else people of this country will not have confidence upon their fundamental rights which are enshrined by the Constitution and will consider their is no Rule of Law in the State as their Right to know the affairs of the Government Machinery is jeopardized.
