Are you surprised Public, you Know in India anything can happen, as there is no Public Accountability and no member of public will to change the system. Public only became Vote Bank. NGO’s busy in how and what manner to secure Foreign Funds to show they are doing Fancy Social Work for the masses, some Social Minded People are on the street to raise Voice but are booked into various Draconian Laws created by Government are put gag in the mouth by the mighty to curb voice against Social Injustice.
Now you can see in India though Member of Parliament (M.P.) Member of Legislative Assembly (MLA) Member of Legislative Council (MLC) though are serving as a Public Servant and are monthly drawing Salary as a member of Vidhan Sabha Mandal or Member of Parliament, they are not restricted to Practice Legal Profession as the law suggested their Work is not of permanent kind and they does not have relationship as a Employee Employer relationship so Court does not restrict them not to practice law in India.
In fact it is not true so, as the Supreme Court in the case law of one BJP worker Ashwini Upadhyay who had filed Public Interest Litigation on the above subject and prayed the Supreme Court to restrained these politicians from not to practice law but the Supreme Court passed an order in this PIL on 25.09.2018 and held that as there is no Rules framed by the Bar Council of India to restrict these Politicians for not to practice law and even section 49 provisions of Advocate Act is also very limited and hence unless rules are not framed and not on record, Court can not passed an order of not allowing these Public Servants Politicians who under the guise of member of Advocate community can practice law. In fact though they are getting big amount of salary from the government tracery out of the tax payers account and these politicians openly play politics with the sentiment of people of the nation.
These politicians are canvassing to garner Votes for their Political Party, during their tenure as a Minister mostly focus on their elected constituency and hardly concern for the whole state except sanctioning of some funds to other sect of constituency. Public does not have space to raise Voice. Though Court can Suo Motto raise the issue but given explanation that Bar Council does not have will power to frame such rules for politicians for not to practice law during their political engagement in Politics of promoting their Political Dictum.
Now we feel and see that, the hope of legal community of having to expressly frame to make Rule by Bar Council of India against Politicians for not to practice law had comes to end as the Ruling Government of BJP have offered a seat of Member of Parliament to the Chairman of Bar Council of India Shri. Manan Mishra and said Chairman of the Bar Council now started raising his voice in fact Big Voice for the welfare of BJP politics as his voice has surfaced in public domain in the context of one Priyanka Gandhi who was addressing some speech in the parliament and she had referred the case of ‘Rahul Gandhi humiliation’ over some issue and then this our Chairman immediately called Press Conference and said that Priyanka Gandhi committed Gross Contempt and he would like to raise that issue in Supreme Court whereas many burning issues are not focused.
Therefore when we see such kind of adverse development of Bar Council how and what manner the welfare of Advocate Community can be protected, those who are in power does not have will to go against the Destructive Political System who day and night play with the sentiment of legal community and allowed Political Affiliated Lawyers to be their Political Workers under the guise of they being a member of legal fraternity.
My dear friends do you think, it is right, as these things are seen by us with our naked eyes and you and me are not to raise voice, why just because of such people are our member of Bar Council, even recently controversy for the appointment of High Court Judge at Bombay, there is strong voice was raised by social minded citizen over appointment of one Advocate Mrs. Aarti Arun Sathe as the said Advocate was a political worker of BJP and was acted as Spokesperson for BJP Party from Feb. 2023 to till she allegedly relinquished BJP party in January 2024. Supreme Court collegium led by CJI Shri. Gavai had approved her name. While seeing such Political Persons appointment to the post of Constitutional Post as a Judge of High Court, how and what manner the people of Maharashtra will accept as their rights really can be protected or will they get justice from any Judge who were having Political Nexus? Many question and voice is unanswered.
Recently surprisingly retired High Court Judge Shri. B. G. Kolse Patil showed concerned how politicial party attached person, can deliver fair judgment? In fact we the people of this Maharashtra eagerly question to Justice K. G. Kolse Patil how he was appointed as a High Court Judge, in fact our sources says Justice Kolse Patil before appointment of High Court Judge was strong politicians of one Political Party and not even handled or appeared in the High Court but directly appointed as a Judge on purely on Political Influence? We are not Idiot or Chor or Corrupt Public Servant of this nation, we protect our Country and truly pay our Taxes to the Government to look after the welfare of the nation.
Further more see how these Political Workers when they became Legislature and holding the Post of Speaker or Cabinet Minister and though are getting Monthly Hefty Salary from the Government from the account of Tax Payers still openly mentioned in their BIOGRAPHY that they are Lawyers and even prefix Advocate before their name and play politics in the Street. Still we the member of legal fraternity does not have Voice to say these Politicians should not practice our legal profession when they are occupying political and legislative post as the interest of larger public interest will not be served from these politicians as they are exclusively look after the welfare of their Political Party such as Bjp etc.
We request our sensible public who can get access to information from Bar Council or from Mantralaya to know during the period of these politicians as a member of Vidhan Sabha how many cases they are appeared as Advocate and at how many cases they have filed their Vakalatnama. Then the true picture will come forward and will see who has been fooled in the process of giving votes to those Advocates.
