Mahalaxmi Race Course PIL (2004) Extensive Public Awareness triggered to Stop Illegal Work at Race Course.
Background:
In 2004, the Royal Western India Turf Club (RWITC) proposed a large-scale commercial redevelopment of the Mahalaxmi Race Course, including an international golf course, 5-star hotel, convention centre and allied facilities. The then Chief Minister Sushilkumar Shinde was reported to have supported this idea.
Sequence of Events
June–July 2004
Advocate Anil Nivritti Bugde filed a Public Interest Litigation (PIL) before the Bombay High Court challenging the proposed commercialisation of the Race Course land.
Press Coverage
The Hindustan Times, in an article authored by journalist Debashish Mahanti, reported on the filing of the PIL. The news piece was widely circulated and created public awareness of the issue.
Judicial Response
The matter was placed before Acting Chief Justice A.P. Shah, who indicated the Court was inclined to examine the issue seriously. In this context, the petitioner was asked to amend the petition.
Subsequent Developments
Around the same time, other public-spirited groups and individuals, including the Bombay Environmental Action Group (BEAG) (led by Goenka and supported by public figures such as B.G. Deshmukh and Julio Ribeiro), filed their own PILs on the same subject.
Withdrawal of Petition
In view of the multiplicity of petitions and the fact that the Court was already seized of the matter, Advocate Bugde withdrew his PIL without filing the proposed amendment.
Outcome
The High Court eventually restrained new construction at the Mahalaxmi Race Course and the 2004 redevelopment proposal did not proceed. The initial PIL filed by Advocate Bugde acted as a catalyst, bringing the issue to public notice and ensuring judicial scrutiny at the earliest stage. Issued for public interest by Ad. Bugde Anil.
