Sub: In the matter of transfer policy of the Government it seems to be breached by your office in the recent Transfer Order passed by your office on 29.5.2025 with regards to the transfer of police officials in the rank of Unarmed Assistant Police Inspector (API)
Sir,
( 1 ) I am activist lawyer Ad. Anil Bugde practising law in High Court, Bombay and take up Social Viable issues concerning public interest, human right violation and of failure of Rule of Law in the State.
( 2 ) I say that I am in possession of the recent order passed by your office on 29.05.2025 which is of transfer of the police officials of the rank of API who have already served their service tenure of 4 years in one District of your range but out of some unseen ground which are illegal in the context of looking in to the provisions of Maharashtra Police Act as contemplated in the provisions of section 22 which read as such ,”
Section 22N(1) in Maharashtra Police Act
(1) Police Officers in the police force shall have a normal tenure as mentioned below, subject to the promotion or superannuation : —
(C) for Police Officers of the rank of Police Sub-Inspector, Assistant Police Inspector and Police Inspector a normal tenure shall be of two years at a Police Station or Branch, four years in a District and eight years in a Range, however, for the Local Crime Branch and Special Branch in a District and the Crime Branch and Special Branch in a Commissionerate, a normal tenure shall be of three years;( 3 ) I say even plain reading of the law is very clear that the Maharashtra Police Force is called a Discipline Police Force and if the office of your Stature takes the unusual stand of the recommendation of IGP Establishment which even are not in consonance with law and API police officers who have already completed their 4 year service tenure of one District need to be transferred to other place of District within your range for the period of another 4 year, but as we have seen through your Order dated 29.05.2025 your office had shown some Conflict of Interest in the matter of some API police offices who though have served their complete tenure in one District and had been given 1 year extension to serve in the same police station which itself seems to great threat to the lives of Citizen who are residing and working for gain in the same section of the District.
1. Seeta Wamanrao Waghmare posted at Yavatmal though completed 4 years in Yavatmal retained in Yavatmal and given 1 year extention to serve in the same District.
2. Ravindra Namdeorao Barad posted at Amravati Rural District though completed 4 years in Amravati Rural retained in Amravati Rural and given 1 year extension to serve in the same District.
3. Kiran Baliram Aute posted at Amravati Rural though completed 4 years in Amravati Rural District retained in Amravati Rural and given 1 year extension to serve in the same District.
4. Mallikarjun Gaurakh Wakhmore at Washim though completed 4 years in Washim District retained in Washim District and given a 1 year extension to serve in the same District.
5. Dadarao Bacherao Kopnar at Amravati though completed 4 years in Amravati Rural District retained in Amravati Rural District and given 1 year extension to serve in the same District.
6. Vaibhav Dnaneshwar Mahagare at Amravati Rural District though completed 4 years in Amravati Rural District retained in Amravati Rural District and given 1 year extension to serve in the same District.
In the premises we the public spirited public felt that office of Director General of Police Maharashtra State are not considering the services of upright police officials who though are capable to serve better in the District of your range are not being considered them to be in charge of various police station of one District and hence all such police officials being sustained humiliation and lowered down their service ability. And such kinds of practice lowered down the police discipline and hence raise concern of Law and Order issue and breach of Rule of Law. You are requested to revert back soon as we have decided to take the issue of such political and unethical transfer before the Hon’ble Court by way of filing Public Interest Litigation. Thanking you.
